Ziggi's Coffee Peachy Summer Sweepstakes Rules 

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE YOUR CHANCES OF WINNING. 

  1. Sponsor: Ziggi’s Coffee Franchise LLC, 241 Welker Avenue, Mead, CO 80542 is the sponsor (“Sponsor”) of the Ziggi’s Coffee Peachy Summer Sweepstakes (the “Sweepstakes”). 

  1. Sweepstakes Entry Period: The Sweepstakes begins on June 4, 2024, at 12:00 am MDT and ends on July 8, 2024, at 11:59 pm MDT (the “Entry Period”). 

  1. Eligibility: This Sweepstakes is open only to legal citizens and permanent residents of the United States who are at least 21 years or older. Notwithstanding the foregoing, Rhode Island and New York residents and employees, independent contractors, officers, directors, owners, and agents of Sponsor, any Ziggi’s Coffee franchise store, or any of Sponsor’s affiliates, subsidiaries, advertising and promotion agencies, and suppliers, their immediate families (spouses, parents, children, siblings, and their respective spouses), and persons living in the same household are not eligible to participate. Each individual who is eligible to participate in this Sweepstakes shall be referred to in these Official Rules as a “Participant”. This Sweepstakes is subject to all applicable laws and regulations and is void where prohibited. 

  1. Agreement to Rules: By entering this Sweepstakes, Participant agrees to comply with and abide by these Official Rules and the decisions of the Sponsor and represents and warrants that Participant meets the eligibility requirements. In addition, Participant agrees to accept Sponsor’s decisions as final and binding as it relates to the content of this Sweepstakes and these Official Rules. By participating in this Sweepstakes, Participant grants Sponsor the right to use their name, likeness, and entry for advertising, publicity, and promotional purposes without further compensation, unless prohibited by law. 

  1. How to Enter: During the Entry Period, Participants may enter this Sweepstakes by only one (1) of the three methods described below: 

    1. Ziggi’s Peach Product Purchase: Participants may enter the Sweepstakes by creating a Ziggi’s loyalty account and purchasing one (1) of the peach products from the menu lineup utilizing their Ziggi’s loyalty account in-store or through mobile app or online orders. Excludes any third-party delivery orders. See list at the bottom of these Official Rules for a list of the participating peach products. A purchase is equal to one (1) entry. 

    2. Online Entry: Participants may enter the Sweepstakes by completing all of the following actions within the Entry Period. Completing these steps for the online entry is equal to one (1) entry:  

  1. LIKE Ziggi’s Coffee’s Instagram post that is dated June 5, 2024, and announces this Sweepstakes; 

  1. FOLLOW @ziggis_coffee on Instagram; 

  1. TAG a friend in the comment section of the Instagram post that is dated June 5, 2024, and announces this Sweepstakes. 

  1. Alternative Method of Entry (Mail-In Entry): Participants may receive one (1) entry to the Sweepstakes without having to make a purchase or completing an online entry by mailing a plain 3”x5” card with their complete name, complete mailing address, phone number (including area code), email address legibly printed or typed onto the card. Then, mail the 3”x5” card in a postage-affixed sealed envelope to: Ziggi’s Coffee Peachy Summer Sweepstakes, 241 Welker Ave., Mead, CO 80542. Mail-in entries must be postmarked by Monday, July 8, 2024, and received no later than Friday, July 12, 2024, to be considered eligible. Sponsor will not verify receipt of entries for Participants. All entries submitted become the sole property of Sponsor and will not be returned. Sponsor is not responsible for late, misdirected, illegible, or damaged mailed entries. 

Entries generated by script, macro or other automated means and entries by any means which subvert the entry process are void. Limit of one (1) entry per person throughout the Sweepstakes Period, regardless of method of entry. Entries received from any Participant in excess of the limitation stated above will be void. 

  1. Prize: One (1) winner of this Sweepstakes ("Winner") will be randomly selected, as further described below, to receive the following prize: a trip for two (2) to Palisade, Colorado that includes: airfare, hotel, transportation, dinner at a local restaurant, two (2) tickets to a Feast in the Field Dinner, two (2) weekend passes to the Palisade Peach Festival, and a Ziggi’s gift card. Approximate Retail Value of all prizes combined is $4,000. The prize consists of only the items specifically listed as part of the prize. No cash equivalent or other prize substitution will be permitted except at Sponsor's sole discretion. Sponsor reserves the right to substitute a prize of equal or greater value. Sponsor reserves the right to substitute airfare or transportation arrangements as needed. The prize will be awarded and is non-transferable by the Winner. If a potential Winner is disqualified for any reason, Sponsor may award the applicable prize to an alternative Winner by random drawing from among all remaining eligible entries. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of the Winner. Acceptance of a prize constitutes permission for Sponsor to use the Winner’s name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law. 

  1. Winner Selection and Notification: One (1) Winner of this Sweepstakes will be selected by a random drawing on or about July 15, 2024. The potential Winner will be notified within five (5) business days of the potential Winner’s selection by email, phone, in-app message, or direct message from Sponsor’s official Instagram account. The potential Winner may be required to sign and return a completed affidavit of eligibility and release(s) via fax or email within 24 hours of prize notification, with the original documents sent to Sponsor via regular mail within seven (7) days of the date of prize notification. Non-compliance with these Official Rules, the inability of Sponsor to timely contact a potential Winner, a potential Winner’s failure to claim a prize within two (2) business days from the time Sponsor sent the award notification, or a prize’s or prize notification’s return as undeliverable will result in such potential Winner’s disqualification and, at Sponsor’s discretion, Sponsor may award the applicable prize to a potential alternative Winner. Receipt of each prize offered in this Sweepstakes is conditioned upon compliance with all applicable federal, state, and local laws and regulations and these Official Rules. Allow up to five (5) weeks from the date declared the Winner for delivery of a prize. 

  1. Odds of Winning: The odds of winning this Sweepstakes depend on the number of eligible entries received during the Entry Period. 

  1. General Conditions: Sponsor reserves the right to cancel, suspend, and/or modify the Sweepstakes if any fraud, technical failures, human error, or any other factor impairs the integrity or proper functioning of the Sweepstakes, as determined by the Sponsor in its sole discretion. In such event, the Sponsor reserves the right to award the prizes at random from among the eligible entries received up to the time of the impairment. The Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Sponsor has the right, in its sole discretion, to maintain the integrity of this Sweepstakes and to void entries for any reason, including, but not limited to: multiple entries from the same user from different IP addresses or multiple entries from the same computer in excess of that allowed by the Official Rules; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of this Sweepstakes may be a violation of criminal and civil laws. Should such an attempt be made, Sponsor reserves the right to seek damages to the fullest extent permitted by law. 

  1. Limitation of Liability: By entering this Sweepstakes, Participant agrees to waive all right to, and to release and hold harmless Sponsor and its affiliates, and its and their respective advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from, any claim, liability, loss, damage and expense (including attorneys’ fees) that may arise out of or in connection with participation in this Sweepstakes or the acceptance, possession, use, or misuse of any prize or any portion thereof, whether caused by negligence or not. In no event will Sponsor and its affiliates, and its and their respective advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors, be responsible for: (i) lost, late, incomplete, or incorrect entries; (ii) a Participant's failure to receive prize notices due to the Participant’s spam, junk e-mail, or other security settings or the Participant’s provision of incorrect or otherwise non-functioning contact information; (iii) unauthorized human intervention in any part of this Sweepstakes; (iv) electronic or human error which may occur in the administration of this Sweepstakes or the processing of entries in this Sweepstakes; (v) technical, hardware, or software errors or malfunctions of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled, or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or used in this Sweepstakes; (vi) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (vii) any typographical, technological, printing, or other error in the offer or administration of this Sweepstakes or announcement of its prizes; or (viii) lost, late, postage due, misdirected, or undeliverable mail. 

  1. Disputes: Except where prohibited, entrants agree that any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Colorado. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes shall be governed by, and construed in accordance with, the laws of the State of Colorado, without giving effect to any choice of law or conflict of law rules. 

  1. No Sponsorship/Endorsement: This Sweepstakes is in no way sponsored, endorsed, or administered by or associated with Facebook, Twitter, Instagram, or any other social networks that are used to share this Sweepstakes, and Participant completely releases Facebook, Twitter, Instagram, and any such other social networks from any and all claims related to or arising from this Sweepstakes. Participant understands that Participant is providing Participant’s information to Sponsor of this Sweepstakes and not to Facebook, Twitter, Instagram, or any other social network. 

  1. Winners List: For the name of the winner (2 weeks following close of Sweepstakes), send a self-addressed stamped envelope to: Ziggi’s Coffee, c/o Marketing 241 Welker Avenue, Mead, CO 80542. 

  1. Privacy: Information collected from entrants is subject to Ziggi's Coffee's privacy policy.
