Ziggi's Coffee & Puffin Drinkwear Ugly Sweater Giveaway Terms

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. This Giveaway (as defined below) is in no way sponsored, administrated by, or associated with Instagram or TikTok. By participating, entrants agree to be bound by these Giveaway Rules and the decisions of Ziggi’s Coffee Franchise, LLC, a Colorado limited liability company (“Ziggi’s”), which are binding and final on matters relating to this giveaway.  

ELIGIBILITY. The Ziggi's Coffee & Puffin Drinkwear Ugly Sweater Giveaway (the "Giveaway") is only open to Instagram and TikTok users who are legal residents of the United States and are 18 years of age or older. Void where prohibited. Employees, officers, directors, agents, and representatives of Ziggi's, Puffin Drinkwear, their affiliated companies, and their immediate family members are not eligible to participate. 

TO ENTER. To enter for a chance to win the Giveaway, you must complete the following steps during the Entry Period:

1.  Visit Ziggi’s Instagram (@ziggis_coffee) or TikTok (@ziggiscoffee) and follow the Ziggi’s account on the platform where you’re entering.

2. Visit the Puffin Drinkwear Instagram (@puffindrinkwear) or TikTok (@puffindrinkwear) and follow the Puffin account on the platform where you're entering. 

3.  Like the designated giveaway post. 

4. Tag a friend in the comments section of the entry post.  

Each tagged friend counts as one (1) entry. There is no limit on entries per person/per Instagram account for the duration of the Entry Period. Multiple entries will not increase your chances of winning. Participants do not need to enter on both platforms to be eligible to win. Entries generated by script, macro or other automated means which subvert the entry process are void. All entries become the property of Ziggi’s and will not be acknowledged or returned. If you do not have an Instagram account, establishing one is free. Entry must not defame, violate or infringe upon the rights of any person or entity.   

ENTRY PERIOD. The Giveaway begins at 8:00 AM MDT on Monday, December 9, 2024, and ends at 11:59 PM MDT on Friday, December 20, 2024. Entries submitted outside this period will not be considered. 

In any Giveaway in which an Instagram or TikTok user must follow Ziggi’s or Puffin, “like” or “share” an applicable post by Ziggi’s or Puffin, and/or tag friends in the comment section on any Giveaway Post, the entrant must maintain the condition on entry at least until the time a winner is announced to be considered eligible to win the Giveaway.  

PRIZE. 

Weekly Prizes:

• December 13, 2024: 30 winners (15 from Instagram, 15 from TikTok) will each receive:

  • One (1) Puffin Drinkwear Sweater.

  • One (1) Ziggi’s Energy Can.

• December 20, 2024: 30 winners (15 from Instagram, 15 from TikTok) will each receive:

  • One (1) Puffin Drinkwear Sweater.

  • One (1) Ziggi’s Energy Can.

Grand Prizes:

• December 23, 2024: Two (2) winners (one from Instagram, one from TikTok) will each receive:

  • Two (2) Puffin Drinkwear Sweaters.

  • Two (2) Ziggi’s Energy Cans.

  • One (1) $100 Ziggi’s Gift Cards.

  • Two (2) $50 Puffin Drinkwear Gift Cards.

The approximate retail value (ARV) of all prizes is $2,500. Prizes are non-transferable and cannot be exchanged for monetary or cash value. 

WINNER SELECTION AND NOTIFICATION. Winners will be randomly selected from all eligible entries as follows:

• Weekly Prize Winners will be notified via a comment tag on the entry post and/or in the stories function of the platform if applicable on December 13, 2024 and December 20, 2024.

• Grand Prize Winners will be notified via a comment tag on the entry post and/or in the stories function of the platform if applicable on December 23, 2024.

The winners must respond and accept the prize via a direct message to Ziggi’s on the respective platform within two (2) business days to claim their prize and provide a valid U.S. mailing address. If no response is received, Ziggi’s reserves the right to select an alternate winner at its sole discretion.

Non-winning entries will not be carried over into subsequent giveaways. Odds of winning a giveaway depend on the number of eligible entries received by the end of the entry period. Ziggi’s may request proof of eligibility. If a winner is found to not be eligible, Ziggi’s may, in its sole discretion, award a new winner or no winner. Decision of Ziggi’s are final.  

PRIZE FULFILLMENT. 
Ziggi's will fulfill the prize within three (3) weeks of winner acceptance. Ziggi's and Puffin Drinkwear is not responsible for late, damaged, or missing mail items. Gift cards or prize pack items will not be replaced if lost, stolen, or damaged. 

LIABILITY AND DISCLAIMERS. 
Released Parties (as defined below) are not responsible for lost, late, incomplete, damaged, inaccurate, stolen, delayed, misdirected, undelivered, or garbled entries for whatever cause or other errors whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Giveaway.  

Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Giveaway.   

Released Parties are not responsible for injury or damage to participants' or to any other person's computer related to or resulting from participating in this Giveaway or downloading materials from or use of the web site.  Persons who tamper with or abuse any aspect of the Giveaway or website, who are in violation of these Rules, as solely determined by Ziggi’s, will be disqualified and all associated entries will be void. Should any portion of the Giveaway be, in Ziggi’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Ziggi’s, corrupt or impair the administration, security, fairness or proper play, or submission of Entries, Ziggi’s reserves the right at its sole discretion to suspend, modify or terminate the Giveaway and, if terminated, at its discretion, select the potential winner from all eligible, non-suspect Entries received prior to action taken using the judging procedure outlined above. Information submitted in connection with this Giveaway will be used in accordance with Ziggi’s Privacy Policy, available at www.ziggiscoffee.com/privacy-policy/. 

Entrants, by participating, agree that Ziggi’s, Puffin Drinkwear, TikTok, Instagram, and their respective parents, affiliates (including Facebook), subsidiaries and advertising and promotion agencies and all of their respective officers, directors, employees, representatives and agents (collectively, “Released Parties”) will have no liability whatsoever for, and shall be held harmless by entrants against, any liability, for any injuries, losses or damages of any kind, including death, to persons, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of the prize or participation in this Giveaway.  In the event of a dispute regarding entries received from multiple users having the same Instagram or TikTok account, the authorized subscriber of the Instagram or TikTok account at the time of entry will be deemed to be the entrant and must comply with these rules.  

LIKENESS, NAME AND IMAGE. For one (1) year beginning the date the Giveaway is announced, the winning entrant grants Ziggi’s the right to publish winner’s real name, Instagram or TikTok handle, likeness and state of residence in connection with the Giveaway, which may be used in a separate post from the Giveaway Post. Ziggi’s may use winner’s name and likeness solely for promotional purposes, without notice or further compensation, except where prohibited by law. 

GENERAL CONDITIONS. By participating, entrants agree to abide by these official rules and the decisions of Ziggi's, which are final and binding in all respects. Ziggi's reserves the right to modify, suspend, or cancel the Giveaway if fraud, technical issues, or other factors beyond its control impair its integrity or operation. 

GOVERNING LAW. The Giveaway is governed by the laws of the State of Colorado, without regard to its conflict of laws principles.
